Terms and Conditions

HOYA will endeavor to publish accurate information on the HOYA HUB and ensure that the services do not have errors or omissions. However, the information published on the HOYA HUB is provided "as is" and without warranties of any kind, either expressed or implied.

The User is fully responsible for all activities that occur in the HOYA HUB under the password(s) provided to it by HOYA. The User will ensure that such password(s) are kept confidential, treated in a secured manner and will immediately notify HOYA of any breach of security with respect to such password(s) or to the use of the HOYA HUB. As the “shop owner” or representative thereof, the User have full responsibility to ensure that log in details are only shared as authorized by the “shop owner” for appropriate purposes. The User is responsible for ensuring that all persons who access the HOYA HUB by internet connection and/or using the password(s) are aware of these terms and conditions of use and that they comply with them.

The User agrees to use the HOYA HUB only in a lawful manner and further agrees not to cause, or knowingly allow others to cause, any nuisance, annoyance, or inconvenience whether to Hoya or to any of its customers or users of the Hoya Pro by any means, including without limitation by a denial of service attack, knowingly introducing viruses, Trojans, logic bombs or other malicious or harmful material.
The User agrees not to use the Hoya Pro to transmit or post any material which is fraudulent, hateful, sexually or racially or ethnically or otherwise objectionable, defamatory, offensive or obscene or menacing.

The User ensures to use up-to-date virus checking software to prevent the introduction of viruses and other harmful code onto the HOYA HUB.

The User acknowledges having no right whatsoever with respect to any and all intellectual property rights used or embodied in or in connection with the Hoya Pro. Hoya reserves all rights related to the HOYA HUB. Nothing in these Terms and Conditions grants the User a right or license to use any trademark, design right or copyright owned or controlled by Hoya or any other third party except as expressly provided in these terms.

HOYA shall in no event be liable to the User for any direct or indirect, special or consequential damages, including but not limited to damages resulting from loss of profits or data arising out of the use or inability to use the HOYA HUB, the misuse of the password or of any other identification data. HOYA disclaims all responsibility and liability related to failure to maintain security of User log in details, sharing of log in details by the User or unauthorized access to the User’s account that may result from unauthorized sharing or insufficient security efforts, unless caused by gross negligence or willful intent by Hoya or its managing personnel .

The User acknowledges that the HOYA HUB is provided via the internet and that HOYA has no control over and/or the security of the internet. HOYA endeavors to ensure that the services are free from bugs and secure, but Hoya does not assume any liability for timely, trouble-free and uninterrupted access to the internet.

While HOYA has used its discretion, best judgment and all reasonable efforts in maintaining a virus-free website, HOYA disclaims any liability for persons, property damage or especially direct, indirect, immediate or subsequent pecuniary loss which may result from transmission or downloading of computer viruses. Hoya cannot be held liable for hardware damage, loss of data, alteration of data, or downtime.

HOYA reserves the right to terminate your access to Hoya Pro, at any time, if you breach these Terms and Conditions.

HOYA reserves the right to modify these terms and conditions at any time and will provide you with timely notice of such change.
